Terms of Use

By installing or launching the App you accept these Terms. If you do not agree with them, do not use the App and remove it from your device.

This is a translation provided for convenience. The Russian version is the legally binding text.

1. The parties

The rights holder is Маркелов Никита Васильевич, registered in the Russian Federation as self-employed (professional income tax payer), taxpayer number 300902719962, contact address digital@plotshift.ru.

The user is any person who installs or uses the mobile application "Memory Shards" (package com.plotshift.memoryshards, the "App").

2. Licence

The rights holder grants you a simple (non-exclusive) licence to use the App for its intended purpose — for personal, non-commercial use, on any number of devices you own, worldwide, for the term of the exclusive right.

The licence is granted free of charge. The App contains no paid features and no in-app purchases.

3. How these Terms are accepted

These Terms are a licence agreement concluded in the simplified manner provided for by Article 1286(5) of the Civil Code of the Russian Federation. They are concluded when you install or first launch the App: beginning to use it constitutes full and unconditional acceptance.

4. What you may not do

You may not:

• distribute, sell, rent out or publish the App or any part of it, or give third parties access to it;
• modify, decompile or disassemble the App, or otherwise attempt to obtain its source code, except where the law expressly permits;
• remove or alter any attribution to the rights holder;
• use the App to create derivative products;
• interfere with the rights holder's servers, place excessive load on them, or access materials otherwise than through the App;
• deliberately prevent advertising from being displayed by technical means.

5. Content

The images, video, audio, text and other materials available in the App are protected by copyright. The rights to them belong to the rights holder or are used by them on a lawful basis. Downloading, copying or using these materials outside the App is not permitted.

The set of levels is extended and changed without updating the App. The rights holder may add, change or remove levels and other materials at any time.

6. Advertising

The App may display advertising supplied by an advertising network. The rights holder is not the advertiser and is not responsible for the content of advertisements, for the goods and services they offer, or for the sites they lead to.

7. Personal data

What data is processed in connection with the App is set out in the Privacy Policy, which forms an integral part of these Terms.

8. The App is provided "as is"

The App is provided on an "as is" basis. The rights holder does not warrant that it will operate without errors or interruption, that it is compatible with any given device, or that the results of using it will meet your expectations.

The App requires an internet connection. The rights holder is not responsible for the quality of your connection or for your data charges.

9. Liability

The App is provided free of charge, and the rights holder's liability for losses arising from use of, or inability to use, the App is therefore limited to the maximum extent permitted by the law of the Russian Federation.

This clause does not limit any rights you have under consumer protection legislation to the extent such a limitation is not permitted.

10. Changes

The rights holder may change these Terms. A new version is published at this address with an updated date in the heading and takes effect on publication. Continuing to use the App after publication constitutes acceptance of the new version.

11. Termination

You may stop using the App at any time by removing it from your device. The rights holder may stop providing access to server-hosted materials in the event of a material breach of these Terms.

12. Governing law

These Terms are governed by the law of the Russian Federation. Disputes not resolved through negotiation are to be settled by the court at the rights holder's place of residence, unless mandatory rules of law provide otherwise.
